Terms of Service

Welcome to StudFinder. These Terms of Service (“Agreement”) are between you and StudFinder LLC (“StudFinder,” “we,” “us,” or “our”) and govern your use of the StudFinder website, mobile applications and related services (together, the “App”). Please read them carefully. By accessing or using the App, you agree to be bound by these terms. If you do not agree, please do not use the App.

Acceptance of Terms

By accessing and using the App, you agree to comply with this Agreement. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms of Service.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the permission of a parent or legal guardian, and you may not buy a subscription without it.

Changes to Terms

We may update this Agreement from time to time. When we do, we will post the updated version here and change the effective date above. If a change materially affects your rights or a paid subscription, we will give you reasonable notice first, such as by email or a notice in the App. Continuing to use the App after an update takes effect means you accept the updated Agreement.

User Account

To use certain features of the App, you may be required to create an account. You agree to provide accurate and up-to-date information when registering. You are responsible for maintaining the confidentiality of your account login information and for all activities under your account. Your account is for you alone: do not share your login or let others use your account. Tell us promptly if you believe someone has accessed your account without permission.

Subscriptions, Billing & STUDs

Some features of the App are free and others require a paid subscription. The features, limits and price of each plan are shown in the App at the time you subscribe, and we may change what each plan includes over time.

Paid plans may start with a free trial. If you do not cancel before the trial ends, your subscription begins and your payment method is charged.

Subscriptions renew automatically at the end of each billing period, at the price then in effect, until you cancel. You authorize us and our payment processor to charge your payment method for each renewal.

You can cancel at any time from your account settings. Cancelling stops future renewals; you keep access to paid features until the end of the billing period you have already paid for.

If you subscribe through Apple's App Store or another app marketplace, that store bills you and its terms govern payment, cancellation and refunds. You must cancel through that store; deleting your StudFinder account does not cancel a subscription billed by an app store.

Except where the law requires otherwise, payments are non-refundable and we do not give refunds or credits for partly used billing periods.

We may change subscription prices. We will tell you before a new price applies to you, and it will take effect no earlier than your next renewal. If you do not agree, you can cancel before then.

STUDs are credits included with certain plans for use with Instore Search. They refill on the schedule shown in the App, do not roll over, have no cash value, cannot be transferred or sold, and expire when your subscription ends.

Use of the App

You agree to use the App solely for lawful purposes and in accordance with these Terms. You are prohibited from:

• Using the App to engage in any unlawful activity, including but not limited to fraud, data theft, or unauthorized access.
• Distributing or storing content that violates intellectual property rights, is offensive, or infringes upon privacy.
• Scraping, crawling or using bots or other automated means to access the App or collect data from it, except through tools we provide for that purpose.
• Reselling or commercially republishing deal alerts, prices or other data from the App, or using them to build a competing product or service.
• Getting around plan limits, access controls or security features, or sharing a paid account so that others can avoid subscribing.
• Interfering with the App or placing an unreasonable load on it.

LEGO Collection & Deal Tracking

The App provides tools for managing and tracking LEGO collections and inventory, including price and market-value information. Values, price histories and profit figures are estimates based on third-party data and may not reflect what an item will actually sell for. We do not provide financial or investment advice, nor do we guarantee the accuracy, profitability, or reliability of any outcomes. You are solely responsible for your purchasing and selling decisions. LEGO® is a trademark of the LEGO Group of companies which does not sponsor, authorize or endorse this site.

Deals, Prices & Availability

Deal alerts, prices, discounts, MSRPs and stock information in the App come from retailers and other third parties and are shown as of the time we recorded them. Retailers change prices and sell out quickly, and the information may be inaccurate, incomplete or out of date. The price and terms on the retailer's own site at checkout are the ones that apply. StudFinder does not sell the products shown, is not a party to any purchase you make from a retailer, and is not responsible for a retailer's pricing, stock, shipping, returns or customer service.

Instore Search

Instore Search reports the price and stock that a retailer's systems showed for a store at the time of the search. It is a snapshot, not a guarantee: an item may be sold, mispriced, held or unavailable when you arrive, and stores may decline to honor a price shown. Confirm with the store before making a trip.

Alerts & Notifications

We send deal alerts and other notifications on a best-effort basis, by means such as push notification, email and Discord. Delivery depends on third parties and on your device and settings, and alerts may be delayed, duplicated or not delivered. We are not liable for a deal you miss because an alert was late or did not arrive.

Affiliate Links & Commissions

The App contains affiliate links. If you click a link to a retailer or marketplace and make a purchase, StudFinder may earn a commission at no additional cost to you. As an Amazon Associate, StudFinder earns from qualifying purchases. As an eBay Partner Network Affiliate, StudFinder earns from qualifying purchases. See our Affiliate Disclosures for more.

Third-Party Sites, Data & Trademarks

The App links to and displays information from third-party sites and services, including retailers and marketplaces such as Amazon, eBay, BrickLink, Walmart and Target. We do not control those sites and are not responsible for their content, products, policies or practices; your dealings with them are between you and them. All product names, logos and trademarks belong to their respective owners. Unless we say otherwise, their appearance in the App does not mean StudFinder is affiliated with, sponsored by or endorsed by them.

Intellectual Property

All content, including logos, text, graphics, and software, on the App is protected by copyright, trademark, and other intellectual property laws. You agree not to use, reproduce, or distribute any content from the App without prior written consent.

Your Content

You keep ownership of the information you add to the App, such as your collection and inventory records, notes and anything you upload. You give StudFinder permission to store, process and display that content as needed to operate and improve the App. You are responsible for your content and for having the right to share it.

Images on StudFinder

Many of the images displayed in the App, such as product and set photos, are not owned by StudFinder. These images may be sourced from third-party content providers or user submissions. StudFinder does not claim ownership of these images and is not responsible for their accuracy, use, or distribution.

Site Uptime and Guarantees

StudFinder makes no guarantees regarding the availability, reliability, or uptime of the App or its features, including but not limited to the website StudFinder.app and its subdomains. The App may experience interruptions, outages, or maintenance periods that may affect your access to the services. You acknowledge and agree that StudFinder is not liable for any such interruptions or any losses, financial or data in nature, incurred as a result of service downtime.

Disclaimer of Warranties

The App is provided “as is” and “as available.” To the fullest extent permitted by law, StudFinder disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure, or that any information in it is accurate or current.

Limitation of Liability

To the fullest extent permitted by law, StudFinder and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or purchases, arising from your use of the App. To the fullest extent permitted by law, StudFinder's total liability for all claims relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim arose or US $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless StudFinder and its owners, employees and affiliates from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the App, your content, or your violation of this Agreement or of the law.

Suspension & Termination

You may stop using the App and delete your account at any time from your account settings. We may suspend or terminate your access, with or without notice, if you violate this Agreement, if your use creates risk or legal exposure for us or other users, or if we stop offering the App. The sections of this Agreement that by their nature should survive termination, including the disclaimers, limitation of liability and indemnification, will survive.

Governing Law & Disputes

This Agreement is governed by the laws of the State of Montana, without regard to its conflict-of-law rules. Any dispute relating to this Agreement or the App will be brought in the state or federal courts located in Montana, and you consent to their jurisdiction. Nothing in this section limits any consumer protection rights you have under the law of the place where you live that cannot be waived.

Privacy

Our Privacy Policy explains how we collect and use your information and applies to your use of the App.

StudFinder Affiliate Program

If you take part in the StudFinder Affiliate Program, the Affiliate Program Terms also apply to you.

General

This Agreement, together with the policies it refers to, is the entire agreement between you and StudFinder about the App. If any part of it is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign this Agreement without our consent; we may assign it in connection with a merger, acquisition or sale of assets.
